TERMS & CONDITIONS
Last updated: October 8, 2026
These Terms & Conditions ("Terms") govern your use of the LEADKIT website and, where applicable, your interaction with LEADKIT regarding creative, design, video, motion, web, AI-assisted, and related services.
By accessing this website or contacting LEADKIT regarding our services, you acknowledge that you have read and understood these Terms.
Specific projects may also be subject to additional terms agreed between LEADKIT and the client through a proposal, invoice, brief, contract, written message, or other written confirmation.
1. About LEADKIT
LEADKIT is a creative studio providing visual and digital creative services, which may include static advertising creatives, graphic design, video editing, motion design, animation, web design, AI-assisted content, and related services.
The exact scope of services for each project is determined individually based on the client's request and the terms agreed before or during the project.
2. Use of the Website
You may use this website for lawful purposes, including viewing our portfolio, learning about our services, and contacting LEADKIT regarding potential work.
You agree not to:
- Use the website for unlawful, fraudulent, or abusive purposes;
- Attempt to interfere with the security or normal operation of the website;
- Attempt to gain unauthorised access to the website, servers, or related systems;
- Copy, scrape, reproduce, or distribute website content in violation of applicable rights;
- Use automated systems in a way that creates unreasonable load or disruption;
- Misrepresent your identity or relationship with LEADKIT.
3. Project Requests and Scope of Work
Before work begins, LEADKIT and the client may agree on the project scope, deliverables, references, deadlines, pricing, number of revisions, technical requirements, and other relevant details.
The client is responsible for providing a sufficiently clear brief, references, source materials, brand assets, text, technical requirements, and other information necessary to perform the work.
LEADKIT provides creative execution based on the information, materials, direction, and vision supplied or approved by the client.
Requests that substantially change the original scope may be treated as additional work and may require additional time and payment.
4. Pricing and Payment
Prices may vary depending on the type of project, complexity, required deliverables, deadlines, revisions, source materials, and other requirements.
The final price and payment terms for a project are communicated to the client before or during the project and may be confirmed through messages, invoices, proposals, or other written communication.
LEADKIT may require full or partial payment before work begins.
Where a deposit or advance payment is required, any cancellation or refund conditions relating to that payment will be determined by the terms agreed for the specific project and applicable law.
Unless otherwise agreed, additional work outside the originally agreed scope may be priced separately.
5. Revisions
The number and scope of revisions may be agreed individually for each project.
A revision generally means a reasonable adjustment to work already created within the approved concept and original project scope.
Requests that involve a new concept, major change of direction, replacement of approved materials, additional formats, new deliverables, or other substantial changes may be treated as additional work.
Additional revisions or changes may require additional payment and may affect the delivery schedule.
6. Client Responsibilities
The client is responsible for reviewing information, materials, and deliverables provided during the project and for communicating corrections or approvals within a reasonable time.
The client is also responsible for ensuring that materials supplied to LEADKIT may legally be used for the project.
This includes, where applicable:
- Logos and brand assets;
- Photographs and videos;
- Music and audio;
- Fonts;
- Illustrations;
- Product images;
- Advertising claims;
- Text and translations;
- Third-party intellectual property;
- Any other materials supplied by the client.
LEADKIT may rely on the client's confirmation that the client has the necessary rights, licences, permissions, or authority to use such materials.
7. Intellectual Property
The client retains ownership of materials and intellectual property that the client provides to LEADKIT.
Rights relating to final deliverables created by LEADKIT are determined according to the terms agreed for the specific project.
Unless otherwise agreed in writing, rights or licences relating to final approved deliverables may be transferred or granted after full payment for the relevant work.
Drafts, rejected concepts, unused versions, working files, templates, internal tools, techniques, processes, source materials, and other materials not included in the agreed final deliverables remain the property of their respective owners unless otherwise agreed.
Third-party materials remain subject to the licence terms and rights of their respective owners.
8. Portfolio and Promotional Use
Unless confidentiality has been agreed or the client requests otherwise, LEADKIT may display completed public-facing work in its portfolio, website, social media, presentations, case studies, or other promotional materials for the purpose of demonstrating our services and experience.
Confidential information, unpublished materials, or materials subject to specific confidentiality obligations will not be intentionally disclosed in violation of an agreed confidentiality requirement.
If a project must remain private, the client should communicate this requirement before or during the project.
9. Deadlines and Delivery
Estimated delivery dates may depend on project complexity, workload, client response times, availability of materials, revisions, and other project-specific circumstances.
LEADKIT will make reasonable efforts to meet agreed deadlines.
A delivery schedule may be extended where delays are caused by late feedback, missing information, changes to the project scope, delayed payments, third-party services, technical issues, or circumstances outside our reasonable control.
10. Approval of Deliverables
The client is responsible for reviewing final deliverables before they are published, distributed, advertised, printed, uploaded, or otherwise used.
The client should verify text, prices, claims, contact details, legal notices, translations, spelling, technical specifications, and other information included in the final work.
Approval of a deliverable may be treated as confirmation that the client accepts the work in its approved form, subject to any separate agreement between the parties.
11. Advertising and Platform Compliance
Where creative materials are intended for advertising platforms, social networks, app stores, websites, marketplaces, or other third-party services, the client is responsible for ensuring that their business, offer, product, service, advertising claims, and campaign comply with applicable laws and platform policies.
LEADKIT may assist with visual execution but does not guarantee that any advertisement, creative, website, account, or campaign will be approved by a third-party platform.
Platform rules and moderation decisions may change at any time and remain outside LEADKIT's control.
12. AI-Assisted Content
Some projects may involve artificial intelligence or AI-assisted tools for image generation, video generation, editing, concept development, enhancement, or other creative processes.
AI-generated or AI-assisted outputs may contain visual inaccuracies, variations, artefacts, or other limitations associated with the technology.
Where AI-assisted production is part of a project, the client is responsible for reviewing and approving the final result before commercial use.
13. Cancellations and Refunds
Cancellation and refund conditions may depend on the stage of the project, work already completed, resources already committed, and the payment terms agreed for the specific project.
Where cancellation occurs after work has started, LEADKIT may charge for work already completed or costs already incurred, where permitted by applicable law and consistent with the terms agreed with the client.
Any specific non-refundable deposit, cancellation fee, or refund arrangement should be communicated and agreed before or during the relevant project.
14. Third-Party Services and Links
Our website or services may contain links to or rely on third-party platforms, tools, hosting providers, communication services, software, plugins, fonts, AI services, or other external resources.
LEADKIT does not control third-party services and is not responsible for their availability, policies, security, content, pricing, or independent actions.
Your use of third-party services may be subject to separate terms and privacy policies provided by those third parties.
15. No Guarantee of Business Results
LEADKIT provides creative and design services but does not guarantee specific commercial, advertising, marketing, financial, conversion, engagement, traffic, sales, or other business results.
The performance of creative materials may depend on many factors outside our control, including the offer, product, audience, advertising strategy, media buying, platform algorithms, competition, pricing, market conditions, and campaign setup.
16. Disclaimer of Warranties
The website is provided on an "as available" basis.
While we aim to keep the website accurate, secure, and available, we do not guarantee that it will always operate without interruption, errors, delays, or technical issues.
Nothing on this website constitutes legal, financial, accounting, investment, or other regulated professional advice.
17. Limitation of Liability
To the maximum extent permitted by applicable law, LEADKIT will not be responsible for indirect, incidental, special, consequential, or similar losses arising from the use of the website or services where such liability may lawfully be limited.
LEADKIT is not responsible for losses resulting from materials or information supplied by the client, third-party services, platform decisions, client modifications, unauthorised use, or use of deliverables outside the agreed purpose.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
18. Confidentiality
Where LEADKIT and the client agree that information or project materials are confidential, both parties should take reasonable steps to protect such information from unauthorised disclosure.
Confidentiality requirements may also be established through a separate non-disclosure agreement or other written agreement.
19. Changes to These Terms
We may update these Terms from time to time to reflect changes in our website, services, business practices, technologies, or legal requirements.
When these Terms are updated, the revised version will be published on this page and the "Last updated" date will be changed.
Your continued use of the website after an update is subject to the then-current version of these Terms.
20. Project-Specific Agreements
These Terms provide general conditions relating to LEADKIT's website and services.
A specific project may be governed by additional written terms, including a brief, proposal, invoice, statement of work, contract, or written agreement between LEADKIT and the client.
If project-specific terms expressly conflict with these general Terms, the specifically agreed terms will apply to that project to the extent of the conflict.
